These terms and conditions apply to every order placed through colinstotalsafety.com, whether you’re buying as a retail customer or ordering through an approved trade account. Please read them alongside our Privacy Policy and our Delivery and Returns Policy, which this document cross-refers to rather than repeats.
1. Who we are
- Colin’s Total Safety Limited (“we”, “us”, “our”), company number 17410859.
- Registered office: Unit 20 Apex Court, Woodlands, Bradley Stoke, Bristol, BS32 4JT.
- Website: colinstotalsafety.com.
2. Definitions
- “Goods” means the safety footwear, gloves, PPE, and other products sold on our website.
- “Retail Customer” means a consumer buying Goods for personal use, outside of a trade or business.
- “Trade Customer” means a business that has applied for and been approved for a trade account under our Trade Account Application Form.
- “Order” means a request to buy Goods placed through our website, by phone, or by email.
3. Placing an order
Placing an Order is an offer to buy Goods on these terms. A contract is only formed when we confirm your Order, whether by an order confirmation email or by dispatching the Goods, whichever happens first. We may decline or cancel an Order at any time before that point, for example where a Good is out of stock, priced in error, or we suspect fraudulent use.
If we cancel an Order you’ve already paid for, we’ll refund you in full.
4. Prices and payment
- Prices are as shown on the website at the time you place your Order.
- We accept payment by PayPal. We do not receive or store your full card or PayPal account details.
- We take reasonable care to make sure prices are correct, but if we discover a pricing error on an Order you’ve placed, we’ll contact you before dispatch to confirm whether you’d like to proceed at the correct price.
- All prices shown on our website include VAT, for both Retail Customers and Trade Customers.
Goods remain the property of Colin’s Total Safety Limited until paid for in full, even though risk in the Goods (for example, loss or damage) passes to you once they’re delivered.
5. Delivery
Delivery timescales, free delivery thresholds, and courier arrangements are set out in our Delivery and Returns Policy. Delivery dates given are estimates, not guaranteed, and we’re not liable for delays caused by events outside our reasonable control (see section 11).
6. Cancellations, returns, and faulty goods
Your right to change your mind within 14 days, and our process for damaged or faulty items, are set out in full in our Delivery and Returns Policy. Nothing in these terms limits your statutory rights under the Consumer Rights Act 2015.
7. Product information
We describe Goods, including safety certifications and standards (such as EN ISO ratings), as accurately as we can from manufacturer information. Colours and images may vary slightly from the Goods received. If a Good doesn’t match its description in a material way, this is covered as a faulty or not-as-described item under section 6.
8. Trade accounts
- Trade accounts are available to businesses that complete our Trade Account Application Form, including two trade references, which we’ll contact to verify trading history in place of a credit reference agency check.
- Approved Trade Customers receive 30-day payment terms from invoice date, unless we agree otherwise in writing.
- We may suspend or withdraw a trade account at our discretion, including for late payment, and may charge statutory interest on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.
- We may ask an existing Trade Customer to reapply or provide updated references from time to time.
9. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be excluded or limited under English law.
For Trade Customers, we’re not liable for indirect or consequential losses (such as loss of profit or business) arising from an Order. For Retail Customers, nothing in this section affects your statutory rights.
10. Intellectual property
The content of our website, including text, images, logos, and product descriptions, belongs to Colin’s Total Safety Limited or our licensors, and may not be copied or reused without our permission.
11. Events outside our control
We’re not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including supplier or shipping delays, such as the extended delivery times currently affecting some overseas-sourced stock.
12. Complaints
If you’re unhappy with an Order, please contact us using the details in section 14 first. Complaints about how we handle your personal data can also be raised with the Information Commissioner’s Office, details in our Privacy Policy.
13. Governing law
These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
14. Changes to these terms
We may update these terms from time to time. The version that applied when you placed your Order is the one that governs that Order.
